Terms of Service

These terms apply to your use of the Pixelate website and to the services we provide. The Pixelate website and services are operated by Pixelate Pty Ltd (ACN 699 872 752 / ABN 15 699 872 752) ("we", "us", "our"). By engaging Pixelate Pty Ltd, you agree to these terms. Project-specific details will also be set out in your written quote or proposal, which forms part of our agreement. If you have signed a Client Service Agreement with us, that agreement governs the services we provide to you and prevails over these Terms to the extent of any inconsistency; these Terms otherwise apply to your use of this website.
1. Our services
Pixelate provides website design and build, branding and content, and ongoing care plans, as set out in your quote or agreement. Plan inclusions, prices and add-ons are as set out in your quote or agreement and may differ from client to client. Descriptions and prices on this website are a guide only and do not form part of your agreement with us.
2. Quotes & pricing
Prices shown on our website are in Australian dollars and are GST-inclusive. The listed price is the total you pay and it includes GST; GST is never added on top. We issue a tax invoice for each payment. Our pricing has two parts: a one-off setup fee to design and build your site, and a monthly care plan that keeps it live. You're subscribing to your website, not buying it: the setup fee launches it and the monthly care plan keeps it live. The care-plan rate depends on the contract term you choose. A quote we provide is valid for 30 days unless stated otherwise.
3. Availability and feasibility of services
Not all services, add-ons or AI agents we describe are available at all times or suited to every business, and we may decline to quote for or provide any service at our discretion. If we accept an order and then find we can't reasonably deliver it, for example due to technical limits, third-party platform constraints, or unsuitability for your business, we'll tell you promptly, cancel that service, and refund the fees you paid for it (for any period it wasn't provided). This applies only to the affected service; the rest of your agreement continues. Nothing here limits your rights under the Australian Consumer Law.
4. Timeframes
We aim to set up and launch your site within 72 hours of receiving all required content and information from you. This is a good-faith estimate, not a guarantee or a fixed deadline: it depends on you supplying complete content and timely feedback and approvals. Branding work, larger builds, add-ons, and delays in content or approvals may extend it. We'll keep you informed along the way.
5. Your content & responsibilities
- You provide the text, images and materials for your site, and confirm you have the right to use them.
- You're responsible for the accuracy of information you give us.
- You agree to provide feedback and approvals within reasonable timeframes.
6. Revisions, add-ons & changes
Each plan includes a set number of revision rounds, as set out in your quote or agreement. Content updates under a care plan cover text and image changes. New pages, structural redesigns, and new features are quoted separately and begin only once you've approved the additional quote. This protects you from unexpected charges and us from open-ended scope.
Optional add-on features (such as e-commerce, online booking, memberships or integrations) are extra to your plan. Any add-on prices shown on our website are a guide only; we confirm a fixed quote in writing before any add-on work begins.
7. The care plan, terms & payment
- Setup fee: a one-off charge, payable as set out in your quote (typically before launch).
- The monthly care plan is required to keep your site hosted, secure, updated and supported, your site stays live for as long as your plan is active.
- Choose your term: month-to-month, or a fixed term of 6, 12 or 24 months. The longer the term, the lower your monthly rate. Our minimum contract term is 6 months; month-to-month has no minimum term.
- First month free: the first month of your care plan is complimentary with any plan.
- How you pay: you may pay the care plan monthly in advance, or pay the whole chosen term upfront in bulk.
Paying for your plan:
- Pixelate may nominate how payments are made, and may change that method on reasonable notice. This includes automatic payment by credit or debit card through a third-party payment processor.
- While your care plan is active you must keep a valid payment method on file, and you authorise Pixelate to charge it for the setup fee and for each care plan payment as it becomes due, until the plan ends.
- Card details are collected and held by the payment processor. Pixelate does not store full card details.
- Withdrawing payment authorisation does not cancel the care plan or remove amounts already due. To end a plan, you must cancel it under the care plan terms.
Late or failed payment:
- If a payment fails or is missed, we retry and notify you.
- If it is still unpaid 14 days after its due date, we may pause the Services including hosting until the account is brought up to date, and the site may go offline while paused.
- Pausing does not cancel the care plan or affect amounts already due.
8. Hosting & domains
While your care plan is active, we manage your hosting and domain and keep your site live. We register and manage your domain on your behalf through GoDaddy; the domain is yours, and we release it to you if you cancel. If you cancel, your site stays live for 7 days so you can export the content you provided, then it may be taken down. The website we built remains ours (see Intellectual property).
9. Intellectual property
The domain, and the content and materials you provide (your text, images and logo), remain yours. Everything we design, build, write or create for your site, the site build, layout, design, code, components, templates, any copy we write, and our methods, is and remains our property, including where it appears in your site. While your care plan is active, you have a non-exclusive, non-transferable licence to use what we've built as your live website. If your care plan ends, your site stays live for 7 days so you can export your materials, arrange a buyout, or migrate; you keep your domain and the materials you provided, and after that the website we built, which is not transferred to you, may be taken down. If you'd like to keep it, we may offer to transfer it for a one-off buyout fee agreed in writing.
10. Cancellation & refunds
The first month of the care plan is free on every plan.
Month-to-month plans can be cancelled any time and end at the close of the current billing period.
Fixed-term plans (6, 12 or 24 months) can also be cancelled early. The plan ends at the close of the current billing period and no further months are charged. Because the lower rate was conditional on completing the term, the months you were charged are re-rated to the rate for the longest term you actually completed, and we invoice the difference. This is the "early exit adjustment":
- completed 12 months or more (on a 24-month term) → re-rated to the 12-month rate
- completed 6 months or more but less than 12 → re-rated to the 6-month rate
- completed less than 6 months → re-rated to the month-to-month rate
Clients who prepaid a fixed term are refunded the months after cancellation, less the early exit adjustment on the months they used.
The adjustment recovers only part of the discount already received on months actually used. It is not a charge for future or unprovided services. The Australian Consumer Law continues to apply.
Your free first month counts towards the months you have completed. The early exit adjustment applies only to months you were actually charged, so there is nothing to adjust for a month you did not pay for. If you cancel during your free first month, no early exit adjustment applies.
How refunds work, including deposits, setup fees and care-plan payments, is set out in full in our Refund Policy, which forms part of these terms. Nothing in these terms or that policy limits the consumer guarantees you have under the Australian Consumer Law, which always apply.
11. Liability
We provide our services with due care and skill. To the extent permitted by law, Pixelate is not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you have paid us in the 12 months before the claim. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, which always applies.
12. Use of this website
You may use this website for lawful purposes only. You agree not to misuse it, attempt to gain unauthorised access, disrupt it, or use it to transmit spam or harmful code. The content on this site (text, design, graphics and code) is owned by Pixelate or used under licence and may not be copied or reused without our permission.
Information on this website, including pricing guides, timeframes and examples, is provided in good faith for general information only. It may change without notice and does not form a binding offer or guarantee; your specific terms are those in your written quote together with this page. Where we link to other websites, we are not responsible for their content. Our AI chat assistant provides general information only, can make mistakes, and its responses are not advice or a binding quote, please confirm anything important with us directly, and don't enter sensitive personal information into the chat.
13. Privacy & cookies
How we handle your personal information is set out in our Privacy Policy, and how we use cookies is set out in our Cookie Policy. Both form part of these terms.
14. Governing law
These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
15. Changes to these Terms
Pixelate Pty Ltd may update these Terms from time to time. When we do, we will post the revised version on this page and update the "last updated" date below. Any changes take effect from the date the revised version is posted. Your continued use of the site or our services after that date means you accept the updated Terms. If you have a signed Client Service Agreement with us, changes to that agreement are governed by its own terms, which prevail over this clause. We recommend reviewing this page periodically.
